DMCA Copyright Policy

Artists and rights holders deserve control over their work. If you think something on this site copies your copyrighted work without authorization, the steps below explain how to tell us.

1. Our position on copyright

It is not our intention to sell anything that infringes a copyright. Should a product, an image or any other material on driftwoodsclothing.com infringe a copyright that belongs to you, please send a notice as described below. We handle notices under Section 512 of Title 17, United States Code — the Digital Millennium Copyright Act (DMCA).

2. Contents of a valid notice

Your notice must be in writing and must contain:

• Your physical or electronic signature, given as the copyright owner or as someone with authority to act for the owner.
• Identification of the copyrighted work you say has been infringed.
• The URL of each page on our site where the material is located.
• Your contact details: full name, mailing address, telephone number and email.
• A statement of your good faith belief that neither the copyright owner, nor its agent, nor the law authorizes the use of the material in the way you describe.
• A statement declaring, under penalty of perjury, both that the notice is accurate and that you own the copyright or may act for its owner.

3. Sending the notice

4. Review and removal

Complete notices are reviewed within 5 business days. Where material appears to infringe, we remove it or disable access to it, and we inform the party who supplied it, if there is one.

5. Disputing a removal

If you believe material was removed in error, you may send a counter-notice. It must include your physical or electronic signature; identification of the removed material and of the place where it appeared before removal; a statement, made under penalty of perjury, of your good faith belief that the removal or disabling resulted from a mistake or from misidentification of the material; and your name, address and telephone number, together with a statement that you submit to the jurisdiction of the U.S. federal district court whose judicial district includes your address (or, where that address is outside the United States, of any judicial district in which Driftwoods Clothing may be found) and that you agree to accept service of process from the original complainant or that complainant’s agent.

6. Repeated infringement

Material from a party that infringes more than once is taken down, and we stop doing business with that party.

7. Knowingly false notices

Section 512(f) of the DMCA allows damages, including costs and attorneys’ fees, to be recovered from anyone who knowingly and materially misrepresents an infringement, or misrepresents that material was taken down in error.
